Chandigarh, December 20: Punjab Director-General of Police (Human Rights) Mohammad Mustafa today approached the Punjab and Haryana High Court alleging delay in hearing of his petition before the Central Administrative Tribunal against the appointment of Dinkar Gupta as the police chief.
Taking up the matter, the Bench of Chief Justice Ravi Shankar Jha and first puisne Justice Rajiv Sharma fixed the case for January 21. The Bench verbally asked Additional Solicitor-General of India Satya Pal Jain to seek instructions from the Union Government.
Appearing before the Bench, senior counsel for the petitioner DS Patwalia, along with Bikramjit Singh Patwalia and Sukhmani Patwalia, had sought directions for calling the records of the application “Mohd Mustafa versus the Union of India and others” before CAT to adjudicate upon the dispute raised in the plea.
As a consequence, delay in adjudication of the original application is rendering the relief claimed by the writ petitioner otiose. “Alternatively, it is prayed that the High Court may be pleased to issue appropriate order or direction, directing the respondent — Union Government to appoint such member/members of respondent — Tribunal so as to complete the required quorum for adjudicating upon matters which require adjudication by more than one member”.
The counsel also prayed for alternative directions to depute member/members on temporary basis till the time the regular members were appointed for adjudication of the dispute pending before the Chandigarh Bench.
