The ED officials are of the view that “by failing to repatriate to India foreign currency equivalent to Rs45.01 lakh within a period of 180 days from the date of its receipt and failing to surrender the same to an authorised dealer during financial years 2006-07 to 2011-12, Dosanjh has contravened Section 8 of FEMA read with Regulation 3 and 6A of the Foreign Exchange Management (Realisation, Repatriation and Surrender of Foreign Exchange) Regulation, 2000.”
The notice issued by Assistant Director Sanjeev Prabhakar to Dosanjh reads: “I am satisfied that there is a prima facie contravention of the provisions of FEMA by you. You are therefore required to show cause in writing within 30 days from the date of receipt of this notice as to why adjudication proceedings as contemplated under Section 13 of the Act should not be held against you for the contraventions of the provisions of the Act. In case you fail, neglect or refuse to appear before me on the appointed date, adjudication proceedings shall proceed against you ex parte
