Chandigarh, June 15:
After the intervention of the Punjab State Commission for Scheduled Castes, the sections of SC/ST Act, 1989 amended in 2015 (Prevention of Atrocities Act) has been added in the case of victim after one and half years.
Divulging further, Commission Member Gian Chand Diwali said, in a complaint with the commission Victim Dalbir Kaur of Patti Duniya Mansoor, Village and Police Station Bilga, District Jalandhar said that she had filed complaint against her neighbour Kishan Kumar Gupta and family members for inhuman torture and castiest remarks. And the police personnel of Bilga police station had filed case No. 190/20 under sections 323/354/148-149 of the IPC, but no section of the SC/ST Prevention of Atrocities Act was imposed despite providing CD of torture to the Police. On the contrary, the Police had registered cross case under sections 107/150 against seven members of her family at Police Station Bilga.
Mr. Diwali said that taking the cognisance of the case, the commission has issued notice to SSP Jalandhar under Section 10 (2) of the Punjab State Commission for Scheduled Caste Act, 2004 and sought report on the complaint. Responding to the letter, the SSP informed on July 3, 2021 that challan against the accused has already been submitted in the court on December 10, 2020, thus the plaintiff could present her case in the court, where the case was pending.
“Disagreeing to the letter of SSP, the Commission wrote to the Director, Bureau of Investigation to further investigate the matter, who responded that the SSP Jalandhar has informed that sections 3 (1) (R) of SC/ST Act, 1989 (amended in 2015) has been added in the case after reviewing the pen drive provided by the complainant and the amendments will be submitted in the court through challan under section 173 (8)”, he added.
