Radhe Maa case: HC issues notice to Kapurthala SSP

Chandigarh, September 6: Acting on a contempt petition alleging that Kapurthala SSP Sandeep Kumar is purposely not initiating action as “highly placed” political leaders are backing Radhe Maa, the Punjab and Haryana High Court on Monday issued notice of motion to the officer.

The notice by Justice Daya Chaudhary came on a petition filed by Surinder Mittal. He was seeking directions for initiating contempt proceedings against the officer for the alleged willful disobedience of order passed by the High Court on December 15, 2015.Radhe Maa, aka Sukhvinder Kaur, is a “spiritual leader” based in Borivali suburb of Mumbai. In his petition, Mittal alleged that it was clear that the respondent had intentionally violated the HCorder and made himself liable to be proceeded against under the contempt of court Act.Mittal’s counsel had told the High Court in December 2015 that Sukhwinder Kaur by posing herself as an incarnation of a Hindu goddess had hurt his religious sentiments. His counsel KS Dadwal had added that the allegations mentioned in his complaint constituted cognisable offence, warranting an inquiry or registration of FIR.

Taking up the matter, the Bench had observed that the arguments raised by the counsel for the petitioner regarding commission of offence on the basis of the material in the complaint appeared to be debatable.The Bench had added: “Without entering into the controversy whether any cognisable offence is made out and leaving it to the authorities concerned, I deem it appropriate to dispose of this petition by issuing a direction to the Kapurthala SSP to look into the authenticity of the allegations and determine if any cognisable offence qua the petitioner is made out from the allegations.”
