Chandigarh, September 6: Permitting supervision of Dera properties process under scrutiny of a retired judicial officer, a Full Bench of the Punjab and Haryana High Court on Tuesday appointed former district and sessions judge Anil Kumar Singh Pawar as court commissioner.
As an application filed by the Haryana Government came up for hearing, the Bench of Justices Surya Kant, Augustine George Masih and Avneesh Jhingan made it clear that Pawar would monitor and instruct the entire sanitisation process before submitting a complete report to the high court and the state government.
The Bench also asked the state government to provide an office, staff, security staff and other assistance to the court commissioner.
The state government had earlier moved the application seeking directions for sanitisation of the Dera’s Sirsa headquarters under judicial supervision. In its application, the state government had, in fact, sought directions “to appoint the illaqua magistrate or a senior judicial officer to oversee the sanitisation process in order to ensure greater transparency”.
Appearing the Bench, Haryana Advocate-General Baldev Raj Mahajan submitted judicial supervision would not prejudice the interests of either party. Besides, the rights of the parties would not be affected in any manner if the entire process of sanitisation was overseen by judicial officers.
The application filed under Section 151 of the Civil Procedure Code added the Dera headquarters at Sirsa was spread over a huge area. A substantial number of residential, institutional and commercial buildings were located inside the complexes.
